How long does registration take, and can I launch before it finishes?

The short answer

Timing depends on the application. The IPI states six working days for examining apparently straightforward applications, and generally two months after payment for others. This does not promise registration by that point. Using the sign before registration remains a separate risk decision.

Separate examination, payment and registration

For straightforward applications, registration follows examination and payment of the required fees. Other applications may receive an objection first. A question about the goods list or distinctiveness needs a response and can extend the overall timetable even though the initial examination is complete.

Record several milestones rather than one desired date: submission, payment confirmation, official response and registration. Keep the responsible person available throughout this period. A letter left unattended internally cannot be compensated for by a printing deadline agreed earlier with your supplier.

Starting sales is not official clearance

You can generally label your own products without a registered trademark. That does not permit infringement of earlier rights. The IPI does not search for those conflicts during registration. Assess the name before investing, regardless of how quickly the office processes the application.

Separate reversible preparation from spending that is difficult to undo. Drafts are easier to change than large packaging runs or branded vehicles. Use the actual search findings to decide which budget is acceptable before registration. Do not yet use ® to suggest that registration has already been completed.

Expedited processing does not improve registrability

For paid expedited examination, the IPI states one month until registration or an objection, and two months for each subsequent procedural step. An objection can still arrive instead of registration. Faster processing does not lower the substantive requirements that the sign must meet.

If a trade fair or product launch is approaching, disclose its fixed date and the spending already committed. Check whether expedited examination addresses the actual bottleneck. An unresolved rights conflict or a logo that is still changing does not disappear through faster official processing.

What you can do now

  • Schedule the launch and official milestones separately.
  • Assess name risks before substantial printing orders.
  • Assign correspondence and payments to an available person.

Frequently asked questions

Does expedited examination guarantee registration within a month?

No. An objection may be issued within that timeframe instead. Expedited processing concerns speed, not a guaranteed positive decision.

Must I wait for registration before any advertising?

There is no general requirement to do so. Use must nevertheless respect third-party rights; pending application status is not legal clearance.
